Never fear: Katie Holmes has not filed for an emergency hearing after all, her lawyer confirms.
"The reports about an emergent filing last Friday are incorrect. Other than her action for divorce, the only pending application filed by Ms. Holmes remains her request for an anonymous caption." (The "caption" refers to the first section of any legal document, which typically includes crucial information such as the name, address and other contact information for the person filing.)
But don't think that means things aren't moving along for TomKat's divorce. Holmes will receive a swift hearing on July 17 in New York City. The order to show cause hearing requires that Holmes give reasons why a temporary decision should be made before the other side responds, and is typically used to speed up the process when a decision is needed more quickly than a notice of motion.
Makes sense.
For his part, Cruise is expected to file divorce papers in the Golden State of California, where joint custody is more common. According to The Hollywood Reporter, Holmes' biggest concerns center around their daughter, Suri, being raised as a Scientologist (you know, that religion founded by the science fiction writer). Apparently Holmes has decided Scientology might not be the best path for her little girl. Better late than never.
In an interview will Elle just over six weeks ago, Holmes stated, "He has been Tom Cruise for 30 years. I know who I am and where I am and where I want to go, so I want to focus on that."
Wherever she's going next, it sounds like the journey will begin on July 17.
